    Delaware has banned 37 invasive plants, and the number will grow. The hit list in a law that became effective July 1 includes plants often sold to homeowners or shared among gardeners and weeds that just seem to be all around that no one today likes. They are: (1) Multiflora rose (Rosa multiflora). (2) Japanese honeysuckle (Lonicera japonica). (3) Oriental bittersweet (Celastrus orbiculatus). (4) Japanese stilt grass (Microstegium vimineum). (5) Japanese knotweed (Fallopia japonica). (6) Autumn olive (Elaeagnus umbellata). (7) Norway maple (Acer platanoides). (8) European reed (Phragmites australis subsp. australis). (9) Hydrilla (Hydrilla verticillata). (10) Morrow’s honeysuckle (Lonicera morrowii). (11) Mile-a-minute weed (Persicaria perfoliata). (12) Yam-leaved clematis (Clematis terniflora). (13) European privet (Ligustrum vulgare). (14) European sweetflag (Acorus calamus). (15) Wineberry (Rubus phoenicolasius). (16) Japanese barberry (Berberis thunbergii). (37) Chinese wisteria (Wisteria sinensis). “We all stand to lose if we allow this to continue,” said Sen. Stephanie Hansen, D-Newark/Glasgow,  the prime sponsor of Senate Bill 22. The bill was passed unanimously in January 2021 and signed into law by the governor in March 2021. The delay in its effective date was to allow time for businesses to adjust. The Delaware Native Species Commission is charged with maintaining a watch list of plants that could be added. A 2021 list prepared for the Delaware Department of Natural Resources and Environmental Control defines invasive plants as “a non-native species that causes environmental harm. Invasive species are very aggressive and can outcompete and displace native flora and fauna.” The list, which specifies that it is advisory and not regulatory, counts 720 plants. Horticulturists for decades have been championing native plants because they not only do better in a geographical area’s weather, surviving rain or drought longer, but they also provide food and habitats for native wildlife. Last year, the Delaware Department of Agriculture warned people not to forage for food in Sussex County because two types of hemlock that resemble wild carrot had been discovered there. The hemlock is poisonous. The Delaware Invasive Species Council has a link to another list of invasives, with helpful descriptions and photos. In some cases, identifying them can be tricky. For instance, there are invasive and native honeysuckles. DNREC also maintains a page on invasive aquatic plants and creatures. The big problem with non-native plants is that native insects and animals don’t recognize them as food or can’t eat them, because they didn’t co-evolve with their defenses. That’s why they’re promoted as being “deer-resistant” or “insect-repelling.” “The places look green, but they’re actually ecological dead zones,” University of Delaware professor Doug Tallamy told WHYY. “Think long and hard before planting a known invasive plant in your landscape and consider removing the ones you already have,” said University of Delaware professor Sue Barton.

  • Is the party over for Delaware liquor stores?

Liquor stores that boomed during the pandemic, when so many Delawareans were sheltering at home, are now reporting declines in revenue. “Everyone I’ve talked to is down” in revenue, said Edward Mulvihill, who networks a lot as president of the Delaware Small Beverage License Council and a board member of American Beverage Licensees. He’s also the fourth-generation owner of Peco’s Liquors in North Wilmington. “That’s more alarming because we know costs have gone up,” he said. Bill Galbraith, owner of Tim’s Liquors in Hockessin and the Wine & Spirit Co. of Greenville, crunched some revenue numbers for DelawareLive. Sales at Tim’s in the first 3½ months of 2024 are down 5% from the same period in 2023, he said, and those sales are down 10% from 2022. “Everything costs more, but less is coming in,” he said. “I’m definitely having problems. Ours is a slow death, and I hope it revives.” Mulvihill brought up the sorry state of package stores in an April 23 House committee hearing on Senate Bill 166, which will allow Delawareans to have home delivery of wine, beer and mixed cocktails from restaurants, brewpubs and taverns. That law, if passed, would offer another reason not to patronize liquor stores, he said. During the lockdown, the state Legislature changed Delaware’s laws to allow customers to take out alcohol with food, a key measure designed to keep the state’s restaurants afloat in the early part of the economy-roiling pandemic. “The rocket fuel that was the pandemic has burned out, and all of those trends have gone back to far more realistic growth (or decline) rates,” said Marten Lodewijks, an executive with IWSR, which analyzes the industry. A 2023 IWSR report predicts steady declines for beer and wine. “The spirits industry held its market share edge over beer and wine for the second straight year in 2023,” CNBC reported. “U.S. spirits revenue grew only a modest 0.2% last year to $37.7 billion, according to the Distilled Spirits Council of the U.S.′ annual economic report. Although the industry gained little total revenue, it outpaced beer and wine sales by 0.4% and 26.1%, respectively.” Delawar’’s “package store customers want the convenience of delivery, too,” said Edward Cooper, a spokesman for Total Wine, Delaware’s largest liquor retailer. “Package stores know this because their patrons have been asking them for delivery. MD and NJ both allow package stores to deliver to their customers (either by the retailer or third party delivery companies).” N.K.S. Distributors, Delaware’s largest liquor wholesaler, did not respond to requests for comment. “We’re just trying to figure out where the customers are going,” Mulvihill said, suggesting first that consumers are cutting back because of inflation. Or maybe they’re concerned about the health effects of alcohol. Or maybe they’re turning to newly legalized recreational marijuana. Beyond liquor stores Whatever the reason, the competition is intense in Delaware. The state has about 330 package stores, Mulvihill said, “one of the highest, if not the highest number of liquor stores per capita of any state.” Over the last three fiscal years, the Delaware Alcoholic Beverage Control Commissioner has issued 305 new licenses in various categories and canceled only 58. Delaware’s tourism office lists 25 breweries, four wineries, three distilleries and two meaderies, all created in the last four decades. Contrast that to Peco’s and Tim’s, which are both about nine decades old. And now the restaurants, brewpubs and taverns who might be allowed to offer home delivery. Mulvihill did note some bright spots, including ready-to-drink cocktails, tequila and box wine. Sales of box wine are up 35% at Peco’s, comparing 2023 to 2022. Box wines provide great value, he said, citing a Bota box that works out to be about $5 for 750 milliliters. However, he said that the silver lining of box wines comes with a cloud: They reduce foot traffic because customers need to replenish their liquor cabinet less often.

  • $200,000 drive to pressure Carney to appoint Black judge
    Supreme Court of Delaware

    A nonprofit formed in the bitter aftermath of a Delaware court decision is launching a $200,000-plus campaign to push Gov. John Carney to appoint a Black judge to Delaware Supreme Court. Citizens for Judicial Fairness — unless recently known as Citizens for a Pro-Business Delaware — wants Carney to name a Black judge to replace Supreme Court Justice Tamika Montgomery-Reeves. She has been nominated by President Joe Biden to join the U.S. Third Circuit Court of Appeals. Montgomery-Reeves, the first Black woman justice on Both the Delaware Chancery Court and the Delaware Supreme Court, must still be confirmed for the federal role. Chris Coffey of the Citizens for Judicial Fairness said his organization would do everything it could to help ensure she is. “Yet again, President Biden has shown bold and courageous leadership while Gov. Carney has been nothing but a coward when it comes to actually making our courts more equitable,” said Coffey in a press release. Carney’s office declined to comment. The group recently pressured Carney to fill an opening on the Chancery Court with a Black lawyer. He didn’t. “We can’t let Carney get away with appointing another member of the Delaware Old Boys’ Club to replace Justice Montgomery-Reeves,” Coffey said in the press release. “We are going to call out Gov. Carney for his lack of leadership and make sure he listens to the voices of thousands of Delawareans who want their courts to actually look like them.” The campaign will include paid digital, print and radio advertising as well as grassroots canvassing, protests and more,” he said. The group will be working with the Rev. Al Sharpton, Pastor Blaine Hackett of Newark and Keandra McDole. Citizens for Judicial Fairness is a Delaware LIVE advertiser. The nonprofit, once heavily focused on Delaware courts and a political foe of Carney, has shifted focus in the past 3 years to increased diversity and equity in federal and other courts. The group “Will continue to fight until Delaware’s courts look like the Delawareans they are meant to represent, and restore trust that they will provide equal justice to all Delawareans,” the press release said. The pro-business group rose in the wake of a case decided by the Delaware Chancery Court, which many considered the best place for businesses to resolve internal corporate conflicts. One of the parties in any suit there must be a company incorporated in Delaware. In the Transperfect case, the Shawe family that owned the language translation company were angry over the court’s order that it must be sold, which it was to owner Phil Shawe. Since then, members of the Shawe family and Citizens for a Pro-Business Delaware have worked against Carney’s election, been critical of both the Chancery Court and the state’s lack of minority judges. The organization has spent hundreds of thousands of dollars lobbying for changes and protesting the $3.9 million in fees that Custodian Robert Pincus’ and Skadden Arps — a vast American international law firm —  charged during the court battle.

  • DOJ wins challenge to Seaford ‘fetal tissue’ law
    Seaford loses fetal tissue case

      A Delaware court has overturned a Seaford law that would have required anyone who had an abortion or miscarriage to pay to bury or cremate the fetal tissue. Vice Chancellor J. Travis Laster of the Delaware Court of Chancery ruled Wednesday morning that Seaford, as a junior sovereign, cannot enact a law that conflicts directly with law established by the State as the senior sovereign. “The U.S. Supreme Court has unleashed a wave of extremist, draconian laws across our country. That wave stops here,” said Attorney General Kathy Jennings in a press release. “This ruling firmly rejects a clearly illegal and harmful attempt to nullify State law and to use dark money to return us to the Dark Ages.” She said the ruling protected people from a cruel and hateful policy. “And it makes clear that Delaware remains a safe haven for choice and reproductive freedom exactly when those sanctuaries are needed most,” she said. The ordinance, enacted on December 14 with an original effective date of Jan. 22, would have forced anyone who had a surgical abortion at an “abortion facility” or a miscarriage at a “health care facility” to have the fetal tissue interred or cremated at their own expense, despite the hardship on patients and clear preemption by State law. The law followed the opening of a Planned Parenthood office in Seaford. Jennings filed suit on Jan. 11 after twice warning Seaford City Council that State law pre-empted the ordinance. The Council passed the ordinance anyway, with a promise that an anonymous outside donor would fund the defense against the State’s incoming lawsuit. The Court’s ruling awards costs to the State. “Even after last week’s devastating Dobbs decision, abortion remains a codified right in Delaware,” said Mike Brickner, executive director of the ACLU of Delaware, in the press release. “Yesterday, our General Assembly fortified that right by expanding access to abortion, and today, the Delaware Chancery Court also reinforced that right, making it clear that municipal attacks on our state-guaranteed right to abortion won’t stand.” “As we expected, Vice Chancellor Laster recognized state law forbids local regulations of the type the city attempted to pass,” said Ruth Lytle-Barnaby, president and CEO of Planned Parenthood of Delaware.  “We are hopeful that we can now focus on providing care to the Seaford area rather than defending ourselves against unnecessary, harmful and legally questionable ordinances.” Since the DOJ’s arguments were based on state law, the state’s case and the Court of Chancery’s ruling are unaffected by the U.S. Supreme Court’s recent ruling in Dobbs v. Jackson Women’s Health Organization.
