New bill would create $100 million trust fund to offer paid family, medical leave

A new bill filled in the Delaware General Assembly Wednesday would tax employers and workers to create a $100 million new program that could give paid family and medical leave to all qualified Delaware workers starting in 2023.

Senate Bill 1, filed by Sen. Sarah McBride, D-North Wilmington, would create the Family and Medical Leave Insurance Account Fund, by taxing both workers and employees each .4 percent of every dollar paid.

That comes out to $4 per $1,000 paid for both employer and worker. Businesses with 20 employees or less would not be required to pay the employer share.

The bill would require employees to have worked in Delaware at least 120 days and earned at least $3,000 to be eligible to apply for payment through the new state office. Workers must document a valid reason such as the birth of a child, a serious illness or a military deployment, McBride said. The worker will be paid up to 80% of his or her salary, up to a maximum of $900 a week.

The program does not allow for a worker to simply walk off a job and expect to be paid, McBride said.

Employees would not be allowed to take the leave at the same time they are on workman’s comp, but they may be able to take the leave a few days at a time over months to cover something like cancer treatments, McBride said. Employers would be required to keep their jobs open for them, under the same rules as the federal Family and Medical Leave Act.

Workers may be allowed to take a maximum of 16 weeks in one rolling year that begins with the first day covered by paid leave for the first event. McBride said that will be allowed to cover a situation such as the birth of a child and then a worker being diagnosed with cancer, she said.

The program would be administered in a new office in the state Department of Labor,

McBride and others who spoke during a 9 a.m. press conference hailed the bill as good for employees, especially new parents and those dealing with critical illnesses, and good for Delaware’s economy because it would encourage workers to come to Delaware and stay in Delaware.

Employers who already offer some kind of family and medical leave would be able to drop what they have in favor of the state system, McBride said.

“More than anything else, this pandemic has shown us just how desperately Delaware’s working families need common sense policies that work for them, whether a person is facing COVID or cancer, a global health crisis or an individual health crisis,” McBride said. “No one should be forced to choose between their paycheck and their health.”

While Alisa Morkides, owner of Brew HaHa! coffee shops said during the press conference that she would be happy to have the program for her 75 employees, other businesses are not so thrilled.

 

Business reaction

Michael J. Quaranta, president of the Delaware State Chamber of Commerce, said Wednesday that the chamber appreciated the deliberative approach McBride had taken with the bill and had met with her several times. Last week, it send her a letter that outlined their reactions.

That letter said that there are 57,000 businesses in Delaware, and slightly more than 56,000 had fewer than 50 employees. It suggested starting the new program with companies that had 35 employees or more, with at least three consecutive years of positive growth and steady finances.

“If the most ‘financially fit’ businesses can adapt to these changes after a few years, you could considering lowering the headcount threshold after more is learned,” the letter said.

Last week’s letter also suggested implementing the new law gradually has it has been in New Jersey, where the weeks of leave rise from 6 in the first year to 8 the second, 10 the third and 12 in the fourth year; exempting startup or new businesses for three to five years; creating a less broad definition of what constitutes a reason to take the leave; only allowing employees who had worked for 12 months with at least 1,250 hours of service to be eligible for paid leave; lowering the pay to the 66.67% as President Joe Biden’s proposed Family Act would do.

“The realities of life and work are ever present, and employers are always trying to balance their workforce and competitive needs against the backdrop of economic factors and life events,” Quaranta said in Wednesday’s statement. “The subject Sen. Sarah McBride has taken on is very complicated and gets exponentially more challenging as smaller businesses are brought into the discussion. Many of these businesses do not have full time, dedicated human resource managers, or benefits policy experts.”

One of the complaints of smaller businesses is that they may have to hire someone to fill the roles of the person on leave. When the employee returns, the business would have to fire that substitute, who then would be eligible for unemployment. That would raise the cost of unemployment for the business.

Quaranta also said in his emailed statement that the chamber’s position “may further evolve as our members offer additional insights and analysis into how this proposal would impact their employees and businesses.”

More about the bill

SB1, which is dubbed the Healthy Delaware Families Act, was based on the best practices of the nine states and the District of Columbia who already have passed the bill, McBride said.

Among the reasons it would offer leave are adoption of a child under the age of 6 and also in some cases of domestic abuse.

The $100 million it will raise would pay for both the money going to workers who use the system and for the administration of the system, she said. She said the Department of Labor had not yet estimated how many people that office would need to handle the program.

Employees would apply to the leave program just like they would apply to unemployment, and checks will come from the Department of Labor.

Because of the way the program is modelled after other state programs and their usage, data, McBride said she does not expect a rush on the system.

The model used other state data to predict usage rates, she said.

The bill will allow self-employed to opt into the system. and it will allow businesses that have leave programs that are equal to or better than the state program to opt out.

The bill says that beginning in 2025, the Department of Labor will be required to report to the General Assembly by April 1 of each year on projected and actual program participation and include purpose, gender of beneficiary, premium rates, fund balances, outreach efforts, and family members for whom leave was taken to provide care.

In the press conference before the bill was filed, McBride talked about how her husband, Andrew, had to quit his job in order to deal with the appointments and treatments related to his cancer. When it became apparent that his case was terminal and he needed caregiving, paid leave allowed her to stay with him and care for him.

“So many Delawareans aren’t as lucky,” she said.

Fifty organizations support the bill, she said.

Ernesta Coursey of Wilmington described how, when she discovered she was pregnant the first two times, she asked her salon employer to save her tips for the lengths of those pregnancies. That money allowed her to cover her rent for two months, because she didn’t have paid leave. She had paid leave, which she called a godsend, and was able to spend more time with her third child after the baby was born.

“I know paid medical leave will lift up our families so we can thrive,” she said.

George Meldrum, president of Delaware’s AARP, pointed out that the state has 128,000 unpaid family caregivers.

“Unpaid family caregiving crosses generational boundaries,” he said. “Entire families are affected.”

Charonda Johnson of Townsend, a disabled veteran, described how her military father’s diagnosis of COVID during the summer threw the family into turmoil, then her mom got sick with something else, a sister was hospitalized for another illness, and, finally, her grandparents’ caregiver also was diagnosed with it. Her father died from COVID.

“My family members had to endure and juggle,” she said.

Johnson said her husband offered to help, but he would have had to take the leave unpaid, and they needed the money.

“I want to tell you many other families across our nation and across our state just like us battled COVID in an ugly way,” Johnson said. “I’m here today because there are thousands of Delawareans who have had to make the same difficult, impossible choices that my family did. And no family should ever have to make such a decision.”

  • Do More 24 sets another fundraising record for Delaware nonprofits

    Shepherd’s Office/Facebook In just 24 hours, Delawareans raised nearly $2.7 million for nonprofit organizations throughout the state as part of the annual “Do More 24” fundraising effort. Sponsored by United Way of Delaware and Spur Impacts, Do More 24 is a one-day online charitable giving extravaganza designed to showcase the work of Delaware’s nonprofit organizations and ignite a culture of community-wide giving. Among the organizations that exceeded their fundraising goals are the Shepherd’s Office and the Barbara K. Brooks Transition House. The Shepherd’s Office in Georgetown is a resource group that aids folks working through challenges caused by homelessness, rejection, addiction, criminal history and socioeconomic status.  The group aims to address those challenges holistically, including social, emotional, physical, mental and spiritual approaches to healing.  The organization provides free hot homemade meals every weekday, including a free lunch on Mondays and Thursdays and a free dinner on Tuesdays, Wednesdays and Fridays. This year, the Shepherd’s Office raised $68,550 from 419 donors, exceeding its goal of $65,000. It also led the leaderboard as the nonprofit with the most individual donations.  “We’re super grateful and humbled that they thought that much of us that they would make a donation online,” said Jim Martin, the group’s founder. “We’re just very grateful to them, and we’re not going to let them down.” The group also won a number of competitions during the 24-hour period that boosted their total donations by almost $4,000.  “Because of their donations we will become the answer to many prayers,” he said. “We would like to thank everyone who donated through Do More 24 and throughout the year to help us help the hurting.” Moving forward, Martin said the Shepherd’s Office plans to “do more of the same, but more of it.”  His group currently prepares about 150 free brown bag meals for people in need every single day.  It’s not cheap, Martin said, and the donations received will help the group continue fulfilling their mission, even in economically tumultuous times. The support he has seen for the organization is so vast that Martin is even considering opening a second location in Lewes.  “One of my goals is to expand to another location,” he said. “Maybe I would be able to pay rent somewhere else like I do in Georgetown. Lewes has a great need for that kind of service and I think we could help address that need.” He said he’s had some difficulty finding a property to rent for his type of organization. He’s hoping to find a place soon so that he can begin discussing expansion with his group’s board.  Before he gets to any of that, Martin said he has about 400 thank you notes to write and mail out.  The Barbara K. Brooks Transition House saw the second most individual donors and came in second on the small nonprofit leaderboard.  The group raised $42,835 from 350 donors, narrowly exceeding its goal of $40,000.  The funds will go directly to women in need, said Deborah Short, president and founder of the Brooks House. The organization offers housing, transportation and scholarships to women ages 18 or older who are in recovery from life-controlling situations, including mental health issues, drug and alcohol addiction, and more. “They’re women who are looking to restore their lives, restore and rebuild relationships and just learn how to live the best life they can live,” Short said. “This will help us fulfill our mission for the year and hopefully we’ll get through this year with that.” She noted that Do More 24 is the only time when the Brooks House directly solicits donations, and this year, generous Delawareans did not let them down.  “Bless you and thank you,” she said to the donors. “You’re such a blessing to us and we really deeply appreciate it.” This year’s fundraising effort brought in $2,683,942, eclipsing last year’s total of around $2 million.   • Former GOP candidate Protack sentenced to year in jail for mailing threats

    A former Delaware Republican candidate for governor and U.S. Senate will spend a year behind bars after pleading guilty to federal charges of mailing threats to his ex-wife’s attorney. Michael Protack, 64, was sentenced Tuesday to 12 months in prison by U.S. District Judge Richard G. Andrews on the charge of mailing threatening communications. According to court documents, Protack used the U.S. mail to send a series of threatening communication to his ex-wife’s attorney. One threat, received on Jan. 7, 2021, stated that the victim should “count on being dead by June 2021.” “You won’t know when, where or how but your end has been written,” the communication said. “Take the time and put your affairs in order because they will not find your body for weeks.”    Another threat, received a couple of months later, contained nothing more than a graphic image of a dead, mutilated body.   One of the last threats received by the victim stated, “I drive past your office every day.”  Protack was arrested on June 11, 2021. In handing down his sentence, Judge Andrews described Mr. Protack’s conduct as a “campaign of terror” and noted the lengths to which Mr. Protack went to conceal his identity as the perpetrator.  Andrews further noted that Protack’s actions represented a “very serious offense” and there was a need for just punishment that would promote respect for the law. United States Attorney for the District of Delaware David Weiss said “Protack’s repeated threats to murder another human being is, indeed, a very serious offense, and the court’s sentence reflects that fact.” “My office is dedicated to obtaining justice for victims of violent crime and holding the perpetrators of these crimes accountable,” Weiss said. “I want to thank the U.S. Postal Inspection Service and the FBI for their diligence in investigating this case and helping bring Mr. Protack to justice.” Damon Wood, inspector in charge of the Philadelphia Division of the Postal Inspection Service said people using the U.S. mail to terrorize others is not that common. “The Postal Inspection Service, however, takes such threats seriously and will aggressively investigate anyone who uses the mail to terrorize or threaten another person,” Wood said. “Protack thought that by using the mail, he would never be identified.  Thanks to the work of local Postal Inspectors and agents of the FBI, he was identified and now has a year in prison to think about his crime.” Wood said anybody who is being threatened through the mail should not hesitate to file a complaint with the Postal Inspection Service. “We have over two hundred years of experience investigating and identifying criminals who use the mail to commit or facilitate crimes,” he said. The case was investigated by the U.S. Postal Inspection Service and the FBI’s Delaware Violent Crime and Safe Streets Taskforce in the Wilmington Resident Agency.  Protack, who graduated from William Penn High School in 1975 and the University of Delaware in 1979, unsuccessfully sought the Republican nomination for governor in 2004 and 2008 and for U.S. Senate in 2006. Assistant U.S. Attorney Briana Knox prosecuted the case.

  • DSU announces largest enrollment in school history 
    DSU is hoping to build on its record enrollment and expand to 10,000 students by 2026.

    After months of teasing a record enrollment, Delaware State University announced Friday exactly what it was. DSU has 6,200 students enrolled, a growth of 33% over the last five years – right through the COVID-19 pandemic, a school press release said Friday. In August, DSU welcomed more than 1,400 first-year students to campus, which is its largest freshman class ever. “The best signal of success for any higher education institution is this: More students wanting to enroll, wanting to join our family, wanting to make their mark in a smaller, more interconnected global community,” said University President Tony Allen.  DSU is Delaware’s Historically Black College and University. This year, it was named the second best public HBCU in the country by U.S. News & World Report, One of Allen’s main goals as president has been to grow the enrollment and to make the student body and faculty as diverse as possible. The school’s enrollment has trended upward in four of the previous five years, and it hopes to reach 10,000 students by 2026, as laid out in its strategic plan, the release said. Delaware State has grown 40% during the last decade, acquired the dying Wesley College in Dover, and significantly increased online and graduate choices.  At the same time, it’s attracted millions of dollars for programs from the likes of major corporations and philanthropist MacKenzie Scott, who gave the school $20 million. RELATED: DSU double: New ag building, $1 million in scholarships  Allen credited enhancements to the state-funded Inspire Scholarship Program, the expansion of DSU’s Early College School, and a new emphasis on the University’s graduate and online programs as drivers for the enrollment spike. The Inspire Scholarship is a four-year, full tuition scholarship available to prospective students from Delaware who have at least a 2.75 grade point average and have exhibited a commitment to public service. Of the almost 700 first-year, in-state students, 67% of those are Inspire Scholars.  The Early College School is a University-sponsored charter school that allows high school students to earn up to 60 college credits before they enter college. More than 90% of its students graduate, higher than the state average of 87%.  For the past five years, 67% of Early College School graduates chose DSU for college. With seventh and eighth grades added to the Early College this year, the Early College School  now has nearly 600 students, according to DSU.  Nationally, the DSU is ranked 8th out of all HBCUs. Allen has previously said he would love for DSU to be ranked first, but that isn’t the school’s primary goal. “We don’t obsess over the rankings,” he said. “We obsess over our students.”

  • Republicans give Carney’s $5 billion budget proposal a C+

John Carney’s $5 billion proposed state budget but argue more should be done to return money to taxpayers given the state’s rosy economic outlook. Carney on Thursday detailed the proposal, which includes raises for all state employees, increased opportunity funding for schools in low-income areas, continued investment in clean water and economic development initiatives and funding for the construction of three new schools and two courthouses. While growing nearly 5% over the current operating budget, Carney’s FY 2023 proposal would fully fund the state’s rainy day fund and set aside $15.2 million for the budget stabilization fund, bringing it to a total of $302.5 million. The state could tap into those funds in case of an economic downturn. “We heard a lot about how money’s going to be spent but there was really nothing said about giving that windfall back to the taxpayers of Delaware, whether through personal income taxes or a reduction of real estate transfer tax,” said Sen. Brian Pettyjohn, R-Georgetown. “Our offices have introduced legislation to actually give some of that money back and we hope that the governor and the majority give some serious consideration to that, especially considering the windfall that we have now.” Pettyjohn said there’s a lot to like in the budget, including $45 million for deferred maintenance projects at the University of Delaware, Delaware State University and Delaware Tech — projects he called “badly needed.” “I do like what he’s doing with economic development,” he continued. “Those are investments that are going to pay off in the future and that’s something that I really support and I think we should be putting money into that on a regular basis.” RELATED: Gov’s budget proposal nears $5 billion; includes raises for all state employees Clean water initiatives and farmland preservation were also popular among the Republican leaders, nearly all of whom represent predominantly agricultural areas of Sussex County.  “The cheapest way to protect land is to protect our farms,” said Senate Minority Leader Gerald Hocker, R-Ocean View.  Hocker said he also appreciates that Carney’s proposal doubles the volunteer firefighter tax credit and puts more than the required amount of surplus revenue in reserves. “For many years we had a lean economy where we needed more tax revenue,” Hocker said. “This budget smoothing fund is going to be a big help there — but they’ve gone to the taxpayers to bail him out and now we have a surplus — I didn’t hear him say anything where he’s gonna go back to taxpayers and thank them for contributing to the state’s economy when it was needed and now we’re going to help them and give it back. We need to give those that paid in to bail the state out some of their money back.” RELATED: Carney ready to spend money in 2022; GOP wants tax relief Rep. Ruth Briggs King, R-Georgetown, shared her thoughts on the budget as a member of the Joint Finance Committee. “We have the highest inflation rates that we’ve had since 1980 coupled with the biggest wage pressure that we’ve had since 1949,” Briggs King said. “So we look at these two things together, we have to say not only how this affects the public sector and state government, but the private sector as well.” “I think it’s sort of hard for some Delawareans when they see the move for the state to make all employees a $15 an hour minimum wage and they’re not there yet,” she continued. “So technically, our working families are paying for increases for workers in the state so I look for some type of equity there.” She argued that after all working families have endured throughout the pandemic, the budget should be crafted not only with the state’s bottom line in mind but also Delawareans’.  A good first step, she said, would be considering any of the six bills Republicans have introduced to return revenues to taxpayers.  RELATED: As revenues rise, Republicans say taxpayers should get some money back Those bills would slash Delaware’s income tax, gross receipts tax and corporate tax; decrease the real estate transfer tax; adjust taxes with cost-of-living increases and give Delaware’s lowest income earners a $500 annual tax credit. In a statement announcing the bills earlier this month, Rep. Rich Collins, R-Millsboro, called it “an embarrassment” that the state government failed to enact tax cuts last year. “After the bills are paid, and appropriate reserves are set aside, I believe government has a duty to return money to the people from whom it was taken,” Collins said. “That was an obligation the legislature failed to honor last year.” Carney’s budget proposal did include some relief, but not in the form of direct tax cuts. The spending plan would exempt 2021 unemployment insurance benefits from Delawareans’ personal income taxes — a move that is expected to collectively save former unemployment recipients $25.2 million over 2 years. The doubling of the volunteer firefighter tax credit would leave $1.8 million in those taxpayers’ pockets. The state would also extend military pension exclusions to attract highly-skilled young military retirees at an expense of $1.5 million, and promote college savings and “ABLE” Plan savings to the tune of $667,000.
