  • Delaware schools need 500 teachers. Here’s where
    Delaware schools have hundreds of openings as students return for the 2022-23 year.

    As the academic year gears up, Delaware schools still have more than 500 teacher vacancies to fill.  “We think about it as a perfect storm of conditions,” said Stephanie Ingram, president of the Delaware State Education Association.  Schools expected to have a higher than normal number of retirements, partly because of the stresses of dealing with the COVID-19 pandemic.  This year, that’s been coupled with an increase in student enrollment of more than 7%, Ingram said. At the same time, “We have fewer graduates from the educator programs than our surrounding states, which leads to the teacher shortage in our schools,” she said. Some education officials believe that schools themselves — and even the media — are to blame for the teacher shortage. Bradley Layfield, principal of Sussex Central High School, said school leadership plays a role in attracting and retaining teachers. “As an administrator, I think that we bear some of this in how we treat our teachers and how we support our teachers to then support students,” he said.  Kendall Massett, executive director of Delaware Charter Schools Network, said more attention should be paid to the teachers who do decide to work in the First State. “While of course we need to get more teachers in and we want to bring more teachers to Delaware … I really wish we weren’t talking about that,” she said. “We need to talk about the fact that we have so many amazing educators that are staying. We are not talking about them.” Massett said the perception that there is a teacher shortage is caused, in large part, by how the media talks about it.  “When you focus on the bad and when you focus on the challenges, that’s what you’re going to get,” she said.  The situation frustrates districts in many ways. “As a superintendent, we’re promising and guaranteeing that children are getting a quality education, and you’re doing everything you can to provide the best quality education you can,” said Jeff Menzer, superintendent of Colonial School District. “The more you string out these vacancies and the longer these vacancies appear and occur, the harder it is to say that to the public,” he said. “That’s really going to be the struggle over the next several years.” Delaware isn’t alone in grappling with a teacher shortage. States across the country are experiencing the same thing. The teacher shortage has been building for a decade, Menzer said. “There’s really not a lot of teachers that are coming out of school with those certification areas or that are out there working right now in those fields,” he said.  A list of Delaware’s vacancies shows that teachers are needed for every grade level, particularly in math, science, special education and world languages. Charter schools aren’t experiencing as many vacancies as district schools, Massett said, in part because charters have more flexibility and fewer layers of bureaucracy than traditional public schools.  For example, she said, some charters have a co-teaching model where two teachers are present in the classroom, which allows charters to make a flex schedule and have some of the co-teachers cover other classes. Districts are coping with the shortages in different ways, Menzer said. A shortage doesn’t necessarily have to result in teachers taking on additional students, he said. The state has in recent years increased the number of grow-your-own teacher residency programs and alternative routes to certification to help prospective teachers get experience at a young age or obtain their certifications in a nontraditional way.  The state has also established a 15-member Education Compensation Committee to look at how teachers are paid, partly because surrounding states are significantly increasing teacher pay, and Delaware doesn’t want its teachers poached. RELATED STORY: Teacher compensation bill aims to strengthen educator pipeline In 2020, Delaware teachers earned a mean salary of $64,853, which ranked 20th in the nation.  The average starting salary for a Delaware teacher with a bachelor’s degree is $43,092. In Pennsylvania, that number is $44,674, in Maryland it’s $47,961 and in New Jersey, it’s $44,258. The compensation committee and the teacher academy pathways programs are an important step toward solving the problem, Layfield said. But “there are many things we can do and it’s not all about pay,” he said. “It’s about making teachers feel supported.” Layfield said many teachers have told him they choose where to work based on the level of administrative support.  Menzer said a major challenge for superintendents is finding creative ways to meet the demand without burdening teachers with more students. Some districts with vacancies distribute students to different teachers while they wait to fill positions, but Menzer said Colonial didn’t want to do that. “You leave those classes in the schedule, and as a superintendent, you find creative ways to fill the positions and get students in front of qualified educators in a qualified educational program,” Menzer said, “and the class size won’t change a bit.” The majority of Colonial’s vacancies are at William Penn High School.  However, Colonial’s “bench” is all dried up, Menzer said. It doesn’t have the normal pool of candidates waiting months or years for a spot to open up to get into the district.  Layfield and Menzer said more teachers are earning their certifications in nontraditional ways in recent years. “We’ve gotten some very good teachers in the last couple of years that have come to us from the private business world that can bring that real world experience,” Layfield said.  “Now we need people in those programs,” Menzer said. Massett said charters are able to offer a variety of teacher residency programs and also can be flexible with employees’ availability.  “Sometimes you have somebody that doesn’t want to work full time,” she said. “Schools can flex the schedule to allow that person to be part-time and they fill in the gaps in other ways.” DSEA’s Ingram said there are lower retention rates for educators in urban schools, “which is a huge contributing factor to some of the shortages we’re […]

  • House Democrats publish final plan for House districts

    A look at the final proposed House Districts in New Castle County. Democratic leaders in the Delaware House of Representatives have published their final proposed House district maps in advance of a Nov. 1 special session to consider a redistricting bill. The special session comes just six days before the deadline for both parties to agree on redrawn districts, given that candidates must live in their districts for at least one year prior to the Nov. 8, 2022 general election. The final maps include several changes from the initial drafts published on Oct. 11. Democratic leaders said the changes were reflective of suggestions made by Delawareans during public comment periods. Protecting edge incumbents? Notably, Representative District 21 was adjusted to ensure that Republican Rep. Mike Ramone will remain within its boundaries.  According to sources familiar with the redistricting process, Ramone is an “edge incumbent,” meaning his residence sits near the boundary line of his current district. When Democrats introduced their proposed maps, his residence fell in Representative District 23, held by Democratic Rep. Paul Baumbach.  That would have meant that if both incumbents opted to run again, Ramone and Baumbach would have likely had to oppose each other in the 2022 general election. Either way, one of the two incumbents would be ousted from the legislature.  During a hearing, House Republican leader Danny Short of Seaford argued that drawing Ramone out of his district would unnecessarily pair incumbents in the same district and “override the choices of the electorate.” Short said instead, Democratic leadership could consider the GOP’s proposed maps, noting that in their proposal both Baumbach and Ramone would remain in their current districts while still meeting all other requirements. That’s in accordance with guidance that Senate President Pro Tempore Dave Sokola, D-Newark, offered during a Sept. 28 hearing at the beginning of the process. Sokola said during the hearing that one priority in redistricting was ensuring “continuity of representation.” He emphasized the need to avoid “the unnecessary pairing of incumbents in the same district because the redistricting process should not override the choices of the electorate unless population has shifted so dramatically that it becomes necessary.” Short indicated that Republicans were in general agreement with the proposal, and adjusting the maps to keep Ramone in his current district would effectively seal the deal. One of Ramone’s constituents, Cheryl McDonough, agreed with Short, saying the “18,000 people who live in the 21st District are totally having our choice of representation taken away from us.” She said she believed Democrats were trying to map Ramone out of his current district because they can’t beat him at the ballot box. “You can’t beat somebody in an election so you just go ahead and take the seat away from them,” McDonough said. “That’s not fair to us. Let the elections decide who represents us — not the General Assembly.” But Claire Snyder-Hall, director of open-government group Common Cause of Delaware, believes protecting edge incumbents violates the Delaware Constitution by unduly favoring an individual.  “We believe that districts ought to be drawn around communities, not incumbents, and the Constitution clearly states that legislators are prohibited from drawing lines to unduly favor any party or person,” Snyder-Hall said. “It seems, in this case, that the lines were changed in order to favor Mike Ramone.” She said she was surprised to hear Sokola argue that lines should be drawn to protect incumbents. “I think that the important thing is empowering communities to elect a person in their district to represent them — not making sure that incumbents have continual elections.” Joe Fulgham, communications officer for the House Republican Caucus, said “we’re very gratified to see that the final version of the map keeps Ramone in the 21st district where he has a long history of serving that community.” What’s next With that issue resolved, Fulgham noted that he’s not anticipating any problems getting the redistricting bill passed in the House on Monday.  “I think it will be a smooth process,” he said.  Snyder-Hall said while it might be a smooth process for legislators on Monday, it has been anything but for members of the public. “I don’t think it’s been smooth sailing for the public because, first of all, the timeline was so short that I don’t think most people were able to view and digest the maps in a way that would allow them to respond,” she said. “I think that people are just starting to understand that the process is going on and so all over the state there are probably people that are now looking at their maps and thinking ‘oh wait,’ but the process is almost over.” Fulgham said the new maps don’t protect incumbents — they protect the communities the incumbents serve. “Ms. Snyder-Hall may be looking at this as the maps are just trying to protect incumbents,” he said. “Well no — what the maps are actually doing is that the communities that are being served by these representatives value the service that they have had and the relationships they have formed with these legislators over a period of many years. Those communities are the ones that want that relationship preserved.” Beyond the 21st District Other changes to the final proposal include: Including all of the Collins Park Community of Interest near New Castle in the 16th District.  Keeping the Dove Knoll Community of Interest near Rehoboth in the 14th District.  Moving the Peninsula on Indian River Bay Community of Interest near Long Neck into the newly constituted 4th District.  Keeping the Community of Interest between Frederica and Milford together in the 33rd District.   • Allowing abortion workers to mask addresses OK’d by Senate
    A bill dealing with protection for abortion providers passed the Senate Tuesday.

    The Senate passed bills Tuesday pertaining to confidentiality for abortion providers, minority party representation on an emergency health committee and payouts for employment discrimination. Senate Bill 158, sponsored by Sen. Kyle Evans Gay, D-Arden, focuses on confidentiality rights for medical providers.  The bill allows anyone who is a reproductive health care services provider or employee to apply for participation in Delaware’s Address Confidentiality Program. That program allows participants to keep their actual address confidential by applying to the Department of Justice for a substitute address for their mail to be delivered. Gay said the bill is in response to the threat of closure for abortion clinics after the Dobbs decision that overruled Roe v. Wade. She said Delaware clinics also face pro-life backlash and cited a Newark clinic that was fire-bombed in 2020. “In addition to actual violence, we know that providers have a fear for their safety,” Gay said. “In the Judiciary Committee when this bill was heard, we heard from a representative of Christiana Care, one of our largest health providers, who had collected stories from providers who quite understandably did not want to stand in front of the Senate.”  The bill was passed unanimously and heads to a House committee.  Senate Bill 66, sponsored by Sen. Eric Buckson, R-Dover, adds the senate minority leader and the house minority leader as members of the Public Health Emergency Planning Commission. As in federal government, a minority leader is someone who represents the party that is not in power. Right now, that’s the Republicans. The senate minority leader is Gerald Hocker, R-Oceanview, and the house minority leader is Michael Ramone, R-Pike Creek South. The bill also would require the commission to meet within 30 days of the initiation of a state of emergency due to a public health emergency. The goal would be to help craft the response to the emergency. Those who opposed Gov. John Carney’s orders for businesses to shut, schools to go online and masks to be worn complained again and again that the Legislature and the public had no input into the moves. “Nearly every other board or commission has minority party representation,” Buckson said. “It’s necessary that the minority party, whether it be Republican, Democrat or other, and the constituents they represent have a seat at the table when discussing these important matters. SB 66 heads to a House committee.  READ: 100% graduation rate for UGrad foster children Senate Bill 145, sponsored Sen. Laura Sturgeon, D-Hockessin, bumps the limit of financial compensation or punitive damages based on the number of employees at a place of business that has been cited for discrimination. The caps are: $50,000 for places with four to 14 employees, $75,000 if a place has 15 to 100 employees, $175,000 for a place with 101 to 200 employees, $300,000 for a place with 201 to 500 employees and $500,000 for a place with more than 500 employees.  Under the bill, the Superior Court of Delaware may order equitable relief available under Title VII of the Civil Rights Act of 1964, as well as back pay and front pay, which is an award made for the period between the date of judgment and the date of reinstatement.  “This is a ceiling and not every jury is going to give them this amount,” Sturgeon said, adding that she wants to protect small business owners in the state.   Her reason for updating the payout scale is that Delaware follows the federal guidelines for caps, which have not been updated since 1991.  Sen. Bryant Richardson, R-Laurel, said he was concerned that Sturgeon didn’t have the number of successful claims for discrimination against the state of Delaware, saying that information could impact the state financially, and a fiscal note might be needed.  Richardson was the only legislator to vote against the bill, which passed and is headed to a House committee.

  • Judge denies request to dismiss McGuiness charge

McGuiness is under indictment on a slew of felony and misdemeanor charges alleging conflict of interest, theft, non-compliance with procurement law, official misconduct and witness intimidation. In April, the auditor’s attorney argued the intimidation charge details acts that occurred prior to McGuiness becoming aware of the investigation. Because she didn’t know she was being investigated, there would have been no way for her to intimidate a witness, her attorney argued.  The state argued McGuiness’ awareness of an active investigation was irrelevant. Her actions may still qualify as witness intimidation if she believed they could potentially influence a witness in a future investigation or trial, even if she was not aware of one at the time. McGuiness’s attorney, Steve Wood, asked Judge William Carpenter of the Superior Court of Delaware to dismiss that charge on April 7. RELATED: McGuiness waits for ruling on charge dismissal, trial date In his May 2 decision, Carpenter said while the court disagrees with the state’s position on what is required to establish the offense, it believes the indictment is sufficient to allow it to proceed to trial.  “In any event, the Court is satisfied that Count Five is sufficiently drafted to allow it to proceed forward,” the decision says. “While it clearly could have been drafted with greater clarity, the Court is convinced that the Defendant has been provided sufficient information to allow her to defend the allegation and that information would prevent future prosecution for this conduct.” A trial date is currently set for the end of May, but during the April hearing Carpenter said he didn’t think a May trial would give either side, or the court, time to properly prepare. If Carpenter moves it, he said it likely will be held in late summer or early fall, but he has not decided. If it’s moved, the trial could be within just a few weeks of the Sept. 13 state primary election. McGuiness has said she plans to seek a second term.   • Move to create Delaware inspector general post gains momentum

    Those who support creating a state office of inspector general say it will help weed out fraud, abuse and mismanagement. As calls mount for the creation of a statewide inspector general’s office in Delaware, one Newark lawmaker is drafting legislation to do just that.  Rep. John Kowalko, a Democrat, will introduce legislation in early 2022 to set the framework for the establishment of the new office, which would be tasked with investigating instances of waste, fraud, abuse and mismanagement within the state government.  The office would also seek to root out inefficiencies within government and streamline processes and practices to save taxpayers money.  The bill, if passed, will authorize the creation of the office and allocate funding for salaries, office space and other start-up expenses.  Kowalko said he expects that the office would require an annual budget of around $2 million to meet its goals. Opponents say that cost is too much to ask of taxpayers, especially when the state already has an auditor of accounts to investigate financial mismanagement and abuse. But with the indictment of State Auditor Kathy McGuiness on corruption charges and multiple instances of shady dealings and perceived cover-ups within the state government, Kowalko and others believe now is the time to act in the interest of transparency.  Some would like to wait and see what exactly ends up in the bill. “The concept of an office of inspector general, when we’ve seen so much bad behavior on the part of Democrats recently, would be a good thing potentially,” said Delaware Republican Party chairwoman Jane Brady. “But I would have to see the language of the bill and how they intend for it to work before I could indicate whether I would support it or not.” This wouldn’t be the legislature’s first attempt to create an inspector general’s office. State Rep. John Kowalko Kowalko co-sponsored similar legislation in 2007 brought forth by then-Rep. Bill Oberle, R-Newark. That bill overwhelmingly passed in the House of Representatives but when it arrived in the Senate, it was tabled, never receiving a vote.  “I’ve noticed situations recently, like the situation with the auditor, the situation with Connections, even questions raised about asbestos removal at that Fisker site,” Kowalko said in an interview with Delaware LIVE News. “There seems to be no government oversight.”  The “situation with Connections” refers to a News Journal/Delaware Online report which found that the state government, for years, sought to obscure Connections’ improper billing of federal programs and record-keeping for narcotics. That mismanagement and lack of oversight led to years of lawsuits and a $15 million settlement.  The questions surrounding asbestos removal at the former Boxwood Road Fisker/GM manufacturing facility in Newport revolve around demolition workers having been subject to unsafe working conditions while removing asbestos because the contractor failed to take action on violations of emission standards. Kowalko believes that the establishment of an inspector general’s office would force some state agencies to be more transparent and open about their policies and practices.  Whistleblower complaints would be investigated by the inspector general’s office and remediation methods would be advised, or in instances of criminal wrongdoing, the inspector general would hand cases off to the attorney general for prosecution.  But the office doesn’t necessarily have to just be a “gotcha agency,” Kowalko said.  “An inspector general’s office is going to give us an opportunity to look at agencies where they may be able to improve their performance,” he said. Claire Snyder-Hall, executive director of open-government group Common Cause of Delaware, said that an inspector general’s office would serve as an impartial watchdog to sniff out fraud, corruption, mismanagement, and malfeasance on behalf of the public. Common Cause’s position is that an inspector general should be appointed with a set term, rather than being an elected office, because they “should be someone who has the qualifications and independence to do the job,” Snyder-Hall said. “The position should not be a stepping-stone for a political careerist.” Kowalko said that those who oppose the creation of an inspector general’s office often express concern about the cost and necessity of establishing a new state agency.  “Oh, no, we can’t create this because we don’t want to create another agency,” he said, alluding to the predominant argument against the proposal. “Well, if you run through a myriad of the agencies that exist now — whether it’s the auditor’s office, the Department of Education or any of the others — and you say that we can’t afford to have oversight on them to protect against fraud, waste or mismanagement, everyone knows that those factors cost money.” Kowalko argued that failures of oversight cost taxpayers “much, much more” than the roughly $2 million per year an inspector general’s office would.  Dr. David Redlawsk, chair of the political science and international relations department at the University of Delaware, said in an interview that claims like that “are hard to be certain about.” “It costs money to establish the office, it costs money to hire the right kind of staff and to pursue what needs to be pursued,” Redlawsk said. “Some would argue that the auditor of accounts should be doing at least some of this kind of work.” He said that the auditor’s job is to seek out financial waste, fraud and abuse within the state government and that an argument could be made that Delaware already has an office that, with the right checks, could have a similar effect of an inspector general’s office.  The question then becomes, “who’s watching the watchers,” Redlawsk said. “As we see this situation, what happens when there are problems in the auditor’s office?” Ultimately, he said, an inspector general’s office can only be effective if it is “truly independent.” “Someone has to appoint the inspector general, presumably the governor with approval at the Senate or something of that nature,” Redlawsk said. “But that office has to have true independence to look anywhere.” He pointed to the April and May 2020 dismissals of five federal inspectors general […]
