  • Residents can comment on pollution permit for Delaware City refinery

      Residents have until July 31 to comment on a proposed air pollution permit renewal for the Delaware City Refining Co. The Delaware Department of Natural Resources and Environmental Control will submit the proposed federal Clean Air Act Title V major source air pollution permit renewal to the U.S. Environmental Protection Agency for that review before DNREC Secretary Shawn Garvin can grant final approval. “It is important to facilities to have up-to-date permits to operate under because the permit documents how they must operate to remain in compliance with applicable air regulations,” Garvin said in a press release. DNREC held a public hearing on July 14, 2020 for the refinery’s draft air pollution permit renewal, with comments accepted through July 31, 2020.  The agency received extensive comments on the draft permit renewal and responded to the comments in a memo from its Division of Air Quality.  The memo is posted as an attachment to the hearing officer’s report with Garvin’s order at this link.  The memo also discusses revisions to be made to the draft permit renewal as a result of comments the department received.  Information presented at the refining company, along with comments received at the hearing and during the public comment period, can be found at this link.   • Bill to create Delaware inspector general moves forward
    House Administration Committee meeting

    A bill to establish an “independent and nonpartisan” inspector general’s office moved forward Wednesday in a Delaware House committee. The House Administration Committee also moved along a bill to encourage filming in the state by offering tax credits. The committee started discussion to create a constitutional right of a clean environment, but, citing time, continued discussion to Thursday’s committee meeting, which starts at noon. Another bill, on Wilmington’s ability to acquire vacant or abandoned property through eminent domain, was postponed entirely to Thursday. Inspector general Rep. John Kowalko, a Democrat from Newark who sponsored HB405, said 36 states have an inspector’s general office, and these offices save taxpayer money involving “waste, fraud, abuse, mismanagement, corruption or other conduct that is harmful to the public interest.” Members of the committee went back and forth on how the bill would affect oversight already handled by the state auditor and attorney general. Rep. Michael F. Smith, a Republican from Newark who had been offering a similar bill, said that the new office would be at the top of the “funnel” in handling issues. It might help out in conflicts among agencies, he said, alluding to accusations around Auditor Kathy McGuiness. The state auditor and attorney general will be helped by this, Smith added, promising to clarify in the bill how the office is organized. After the committee and the public finished their comments, Kowalko promised to address these interdisciplinary issues. Multiple representatives of the Delaware Coalition for Open Government argued that some recent issues ins the news – including false claims and inadequate record-keeping by Connections Community Support Programs – would have been alleviated by the new office, because other state agencies were slow to act. Nick Wasileski of the coalition read into the record a list of 16 groups that supported the bill, including the local League of Women Voters and the American Civil Liberties Union. Claire Snyder-Hall of Common Cause argued that the state cannot afford to not support the office. The attorney general “had no objections” about the office and thought it would be “beneficial,” said John Kowalko III, the sponsor’s son and another member of the coalition, who said he was involved in drafting the bill. “The spirt of the bill is about public trust,” Smith said. An attached fiscal note said the bill would cost the state $457,038 in 2023; $1,095,175 in 2024; and $1,152,717 in 2025. Films, TV shows, esports and videogames The committee also moved along a bill to provide a 30% transferable tax credit for investments in the state in film, television, esports or videogame productions. ““You have to take chances,” said Rep. Valerie Longhurst, sponsor of HB465, and chair of the committee. “I think that this is a great opportunity.” During the public comments, three people in the entertainment business praised the bill and cited how it would make the state competitive (and, unsaid, their business more profitable). However, Rick Geisenberger, secretary of finance, said there has been an “extensive and very mixed” economic analysis of such credits or incentives for taxpayers. Constitutionally protecting resources Introducing herself as the legislature’s youngest member, Rep. Madinah Wilson-Anton, a Democrat representing Newark, opened up discussion of her bill that would eventually amend the Delaware Constitution “to conserve, protect and maintain Delaware’s natural resources.” She said she’s not concerned “about a specific problem” with HB220 but a “mission” to maintain a clean and healthy environment. But she then cited specific problems, including Delawareans who have to rely upon bottled water to drink and how Delaware has the nation’s highest percentage (97%) of impaired rivers in the country. HB220 describes itself as “the first leg” in an amendment process – and what could be a lengthy process, Longhurst warned. “I had to take a loss before I got a win,” she said, recalling the years she fought for equal rights. Shawn M. Garvin, secretary of the Delaware Department of Natural Resources and Environmental Control, said the intent is “consistent” with DNREC’s mission, but its overreaching breadth means he cannot support it as written. “I have significant concerns,” he said. Some of the committee discussion centered on lawsuits, such as who could sue whom and the chance of “frivolous” suits. How current regulations maintain access to clean water was also a topic. An outside expert brought in by Wilson-Anton defended the need to develop a constitutional authority because existing laws aren’t working. Public comments included opposition by the Delaware Farm Bureau and the New Castle County Chamber of Commerce and support by individuals concerned about their health and the health (and death) of others.

  • Transportation plan eyes Tyler McConnell, Hares Corner, I-95

    Proposals for a notoriously congested bridge (the Tyler McConnell, in North Wilmington), Delaware’s busiest intersection (Hares Corner, aka U.S. Route 13 and Delaware Route 273) and Interstate 95 in Cecil County highlight the latest regional transportation plan. The Wilmington Area Planning Council will collect comments at an open house Wednesday, Feb. 8 in Newark and online through March 6. Registration is requested for the event, titled 2023 Our Town. Speakers at the meeting include Rebecca Higgins, senior policy advisor at U.S. Senate Committee on Environment and Public Work, on funding an equitable system; and Todd Litman, founder of the Victoria Transport Policy Institute, on developing innovative solutions to transportation problems. The plan runs through 2050 and is the latest in a series going back to 1996. “Only transportation projects found in the RTP are eligible for federal funding,” the council says in introducing the plan. “It is a living plan, subject to continual revision (at least every four years) and a tool for informed transportation and policy decisions that reflect public views.” The council is proposing several policy “tweaks” in this update. • “Eliminate all traffic-related deaths and severe injuries, while increasing safety, health and mobility for all. • Support national defense preparedness and data sharing. • Reduce carbon emissions via a new performance target for lower vehicle miles traveled by 2030. “There are more than 100 projects on the draft ‘fiscally constrained’ (or financially reasonable given the forecasted funding) project list in New Castle County and about a dozen in Cecil County,” the council says. Of course, proposals, priorities and prices change. Here’s a look at the ones that are the most significant (they’re also the most expensive). Roads Widening Interstate 95 through Cecil County, $1.2 billion estimated cost, in service 2050. Hares Corner grade separation, $469 million, 2045. The traffic lights on U.S. 13 and Delaware 273 – Delaware’s busiest intersection – could be replaced by an overpass and cloverleaf ramps, like what now exists at U.S. 13 and Delaware Route 141, a mile or so to the the north. “We would expect that the DelDOT planning process will evaluate traditional designs as well as the innovative concept presented in 2020 and 2021 Bike Delaware events,” said Heather Dunigan, principal planner for the agency. Widening Delaware Route 1, U.S. 40 to Road A (near Christiana Mall), $300 million, 2036. Long-term safety improvements and congestion mitigation by widening the highway. Maryland 222, U.S. Route 40 to Maryland Route 275, and the I-95 interchange, $270 million, 2045. Adding new lanes in each direction and reconstructing the interchange near Perryville, Maryland. I-95/Delaware Route 896 interchange work, $257 million, 2026. Ramp realignments and other geometric improvements to address congestion and crashes caused by merging and diverging through, entering and exiting traffic. Widening Route 1, Tybouts Corner to Road A (near Christiana Mall), $115 million, 2024. Short-term safety improvements and congestion mitigation by widening nine miles from just south of I-95 to Tybouts Corner. Reconstructing the Delaware Route 1 Tybouts Corners interchange, $111 million, 2035. U.S. Route 40/Delaware Route 7 intersection, $96 million, 2040. Geometric improvements to improve safety and operations, with the potential for a grade-separated interchange. Triggering of project will occur through DelDOT’s U.S. 40 corridor plan monitoring process. Tyler McConnell Bridge, $90 million, 2045. The plan is to widen the bridge to four lanes and also accommodate bicycle and pedestrian traffic. Transportation Transportation Improvement Districts, $1 billion, multiple dates. New to the plan is funding to implement Transportation Improvement Districts, “where land use and transportation is planned in detail in advance, such that development consistent with that planning can pay a readily determined fee and forego the Traffic Impact Study process,” the plan says. Districts are established for southern New Castle County and the Eastown and Westown areas of Middletown. DelDOT and Newark are developing a district, and DelDOT and New Castle County are considering one for Churchmans Crossing. Transit service capital and operations, $888 million, multiple dates. “These will primarily cover increased bus and commuter rail service frequencies, expanded bus routes and the associated purchase of buses, operating costs and improved bus stops such as rider amenities and pedestrian access,” she said. Support for new technologies, $567 million, multiple dates. “Infrastructures to support development of infrastructure for connected and autonomous vehicles, alternative fuel vehicles, micromobility (i.e. bikeshare and shared e-scooter systems) and whatever other new technologies might emerge,” Dunigan said. Active transportation, $215 million, multiple dates. “This would primarily cover walking and bicycling infrastructure, including filling gaps between existing sidewalks, new shared-use pathways, pedestrian safety improvements and bicycle infrastructure,” Dunigan said “but might also include roadway safety improvements to foster better conditions for walking, bicycling and transit users.”

  • WilmU law school to start with 100 students, be accredited by 2025 
    WilmU School of Law Dean Phillip Closius in his first presser Thusday.

    Wilmington University’s School of Law expects to open in August 2023 with 100 students, 50 during the day and 50 at night. The school will not yet be accredited by the American Bar Association.  That usually takes about three years, said Dean Phillip Closius Thursday during the school’s first press conference. He expects it to be by March of 2025, a year before the law school’s first class takes the bar exam.  During the school’s press conference, Closius said he didn’t want anybody to feel like they weren’t at a quality school if they choose Wilmington University law classes.  Coming from a different state has made him immune to what he calls the “Wilmington inferiority complex.” “So many say ‘Well, we’re not Philadelphia, we know we’re not New York,’ but I don’t care what you’re not, I care what you are,” he said. “I can sell Wilmington, and you’re a lot more attractive than you think.” WilmU announced two weeks ago that it would be starting the state’s second law school. The other is Widener University’s Delaware Law School. It deferred offering more information until today’s press conference. Closius was the dean of the University of Baltimore School of Law for four years and also taught law at the University of Toledo School of Law for 28 years before joining WilmU. WilmU’s website now lists the required courses, which include 29 first-year credits, 38 upper-level credits and 19 elective credits.  Originally, WilmU planned on making the night sections exclusively online, but the ABA forbids the online-only option until the school has earned provisional accreditation. All night courses, except the contracts class, will be in-person.  Course requirements at WilmU’s School of Law If the school doesn’t win accreditation by 2025,it should soon after, Closius said. “The ABA will  tell us … what we have to do to fix it,” he said, “and we still have another year to get it done before our first class takes the bar, so we’re going to get two bites at the apple.” For a law school to be ABA accredited, it must apply to the ABA and demonstrate that it has achieved academic standards set by the ABA over a period of time.  The national standards, set by the ABA, are updated frequently. The most updated version of the standards, released in Aug. 2022, can be found here. Students do not have the option of taking the bar exam until their school is ABA accredited, and they must take the exam during their final two years before graduating. The test can be retaken if a student doesn’t pass, and many don’t on their first attempt.  The application for WilmU’s law school is now open and can be found here.  The deadline to apply is July 31, 2023 but Associate Dean of Law Admissions Jeffrey Zavrotny said the school recommends applying before April 31.  Decisions on scholarships will be made in Feb. 2023 for admitted applicants, he said. “Don’t come because we’re affordable, come because you agree with the mission,” Closius said. “Come because this is what you want to do and because you think we’re the best place to do it, and then let the affordability be the benefit.” The cost for full-time students in WilmU’s School of Law will be $24,000 per year and $18,000 for part-time students, which the Closius said is the cheapest tuition of any law school in the region.  To compare, Widener University’s Delaware Law School costs a first-year, full-time student $57,376 per year and part-time students $43,032. “We are trying to break the paradigm of where law schools are going with student debt,” he said. “In this region, the cheapest law school tuition is $57,000, and it ranges up to $75,000 a year at Penn, so we’re considerably under.” Closius wants to attract prospective lawyers from all over the country, and he understands that many of them will return to their home state after graduating.  However, he reinforced that they will be Delawareans first and foremost if they go to WilmU’s law school.  “While you’re with us, we expect you to be part of the Delaware legal community. because that’s what we are,” he said. “We expect you to be part of this legal community and to give service to the residents of Delaware.”
